Words used in these terms
"OnlyEighteen", "we", "us" and "the administrator" mean the administrator of the onlyeighteen.com service. "Creator" means a verified account holder who publishes content and receives payments from fans. "Co-performer" means any person, other than the creator, who appears in a creator's content. "Fan" means an account holder who views content or pays creators. "Team member" means a person who acts for a creator or an agency through a team seat. "Content" means anything uploaded, posted, streamed or sent through OnlyEighteen, including messages, captions, tags and profile text. "Fan payment" means any payment from a fan to a creator, such as a subscription, bundle, pay per view post, paid message, tip, custom request or live stream tip. "Plan" means a paid Pro, Studio or Agency subscription for creator tools.
Only verified adults may use OnlyEighteen
OnlyEighteen is for adults only. To hold any account you must be at least 18 years old and also of legal age in the country, state or region where you live, if that age is higher than 18. You must also be legally allowed to view and, for creators, to produce adult content where you are. If any of this is not true for you, you may not create an account or use the service.
The number in our name is the minimum threshold, nothing more. It does not describe the age of any creator, and no content may suggest that anyone in it is below the age of majority.
Verification duties for every account
Verification is a condition of using OnlyEighteen, not an option.
- Creators must pass a check with a valid government issued ID and a live selfie before their profile or any content is public. A profile becomes public only after identity approval.
- Co-performers must each accept an invite link, pass their own ID and live selfie check and sign a consent for each release before content showing them is published.
- Fans must pass an age check before their first purchase and before viewing the first explicit post. The method depends on the law of the fan's region (an ID and live selfie check where a law requires a document, or a facial age estimate with a safety buffer elsewhere, followed by an ID check if the estimate is under 25).
You agree to provide true, current and complete information, to use only your own documents and your own face, and to repeat a check when we ask. We may refuse, pause or withdraw verification, and we may ask any account holder to verify again at any time. Using someone else's document, a manipulated image, a recording instead of a live selfie or any attempt to get around a check is a serious breach and leads to termination.
Your account and your team
You must keep your sign in details secret and tell us at [email protected] if you think someone else has accessed your account. You are responsible for all activity on your account, including activity by team members you invite. Team members must themselves be verified adults and may act only within the role you give them. One person may hold one creator account and one fan account. Accounts may not be sold, rented, shared or transferred.
Content rules
All content must follow our content guidelines, which form part of these terms. Among other things, the following are prohibited: any content involving a person under 18 or a person whose age has not been verified, wording, settings or styling that suggest a person is under the age of majority, content of any person without their documented consent, non consensual content of any kind, real or simulated violence presented as sexual, content that is illegal where it is published or viewed, sharing of personal contact data, and pushing fans to pay outside OnlyEighteen.
Wording that suggests a person is under 18 is rejected automatically in titles, captions, tags, profile names, bios, mass messages and search. Media is checked automatically before it goes live and then reviewed. Anything ambiguous is rejected by default. We may decline, remove, restrict or geo block any content at any time.
We have zero tolerance for sexual abuse material involving anyone under 18. When we find it, the account is blocked at once, evidence is preserved and a report goes to NCMEC and the relevant authorities.
Consent and co-performers
A creator may publish content showing another person only if that person is a verified co-performer with a signed consent for that specific release. The creator is responsible for making sure everyone on camera has been invited and approved before publishing. Consent can be withdrawn for future use as the law allows, and a co-performer who asks for removal is handled as a priority. Identity documents and consents are kept by the platform as records required by 18 U.S.C. 2257 and similar laws elsewhere, as described in our 2257 statement. Documents are never shown to fans.
Who owns content
Creators keep ownership of their content. By posting, a creator gives the administrator a worldwide, non exclusive, royalty free license to host, store, copy, review, display, distribute and adapt the format of that content to run OnlyEighteen, for as long as the content is on the service and for a reasonable time after removal to finish backups, legal holds and records. Fans receive a personal, non transferable license to view content they are entitled to, on OnlyEighteen only. Fans may not download, record, screenshot, copy, share or resell content. Media carries a watermark with the viewing fan's handle so leaks can be traced.
Platform fee of 20 percent
The platform fee is 20 percent of every fan payment, the same for every creator and on every plan, from the first sale. The creator receives the remaining 80 percent in her balance. No plan is needed to join and earn. Creators set their own prices within the ranges the service allows.
Fan purchases
Fans pay by card or crypto through a card processor that supports adult creator platforms or through crypto payment options where available. Every price is shown before the fan confirms. Fan payments are made to OnlyEighteen, which collects them on behalf of the creator and credits the creator's balance after the fee. A fan subscription to a creator renews at the end of each period at the price shown at purchase until the fan cancels. A cancelled fan subscription keeps access until the end of the paid period. Purchases of pay per view posts, paid messages, tips and custom requests are one off payments for a specific item and do not renew.
Creator tool plans
Plans add tools and never change the fee. Pro costs $49 per month or $288 billed yearly, Studio costs $149 per month or $888 billed yearly, and Agency costs $499 per month or $2,988 billed yearly. Current prices and features are listed on OnlyEighteen pricing.
- Plans are subscriptions that renew automatically at the end of each monthly or yearly period until cancelled.
- An upgrade to a higher plan, or a change from monthly to yearly billing, charges the price difference immediately. The new plan starts once that payment succeeds. If the payment fails, the current plan stays.
- A downgrade takes effect at the start of the next period.
- You can cancel any time in your account settings. Your plan stays active until the end of the period you paid for and does not renew after that.
- Usage limits count use within a billing period. Deleting items does not give the allowance back.
- Price changes apply from your next renewal after we give you notice.
Payouts to creators
A creator whose identity is verified may request a payout of her available balance to the payout methods available in her country, including crypto where available. We may delay or hold a payout while we look into suspected fraud, chargebacks, prohibited content, a disputed consent or a breach of these terms, and we may deduct refunds, chargebacks and related fees connected to her content from her balance. Creators are responsible for their own taxes and for giving any tax information we are required to collect.
Refunds as the law provides
Fan payments give immediate access to digital content or a service, so they are generally final once the content is unlocked or the message, tip or request is delivered. We refund a fan payment where the charge was a technical error or a duplicate, where paid content was not delivered or was removed for breaking our rules before the fan could access it, where a paid custom request was not fulfilled, or where the law of your country gives you a right to a refund. Write to [email protected] within 30 days of the charge. Plan fees are not refunded for a partly used period, except where the law requires otherwise. Approved refunds go back to the original payment method.
Chargebacks
If you think a charge is wrong, contact [email protected] first, because we can usually fix it faster than your bank. Filing a chargeback for a payment you authorized and received is a breach of these terms. While a chargeback is open we may suspend the account that filed it, and we may close it if the chargeback was unjustified. The amount of a chargeback on a fan payment, and any fee linked to it, may be deducted from the creator's balance.
Takedowns and copyright notices
Anyone, with or without an account, can report content through the report button on every post, profile, message and stream, or on our report page. Content reported as illegal is hidden at once and decided within 24 hours.
If you believe content on OnlyEighteen infringes your copyright or shows you without consent, send a notice to [email protected] with your contact details, the address of the content, a description of the work or the reason for the request, a statement that you believe in good faith that the use is not authorized, a statement that the information is accurate, and your physical or electronic signature. We remove or disable access to the content and tell the uploader. An uploader who believes a removal was a mistake may send a counter notice with the same details and a statement under penalty of perjury. Accounts that repeatedly infringe are terminated. Creators on a plan can also send takedown notices for leaks found elsewhere through their dashboard.
Things you must not do
- Use OnlyEighteen if you are under 18 or under the legal age where you live
- Verify with someone else's document or face, or help anyone get around a check
- Post, request or share prohibited content, or content of anyone without a verified consent
- Ask for or share personal contact data, or push payments outside OnlyEighteen
- Download, record, scrape or redistribute content
- Impersonate another person, run fake accounts or use bots
- Interfere with the security or operation of the service
Suspension and termination
You may close your account at any time by writing to [email protected] from the email on your account. We may suspend or close an account, remove content and hold balances where we reasonably believe these terms or the law have been broken, where verification fails or is withdrawn, or where we are required to by law. Where the law allows, we tell you the reason. Balances that are not linked to a breach are paid out after closure, minus refunds and chargebacks. Records that the law requires us to keep, including verification and consent records, are kept after closure for the period the law requires.
Liability
OnlyEighteen is provided as available. We work to keep it secure and running, but we do not promise it will be uninterrupted or free of errors. Creators are responsible for their content and for having every consent required. To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or loss of data, and our total liability to you for any claim is limited to the fees you paid us, or the platform fees we earned on your sales, in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law or takes away rights you have as a consumer under the law of your country.
Changes and governing terms
We may update these terms to reflect changes in the service or in the law. We give notice of material changes by email or in your account before they take effect, and continued use after that date means you accept the updated terms. If you do not accept them, you can close your account. These terms, together with the content guidelines, the privacy policy and the cookie policy, are the whole agreement between you and the administrator. If any part is found unenforceable, the rest stays in force. Mandatory consumer protection rules of the country where you live continue to apply. Questions about these terms go to [email protected].
